These Terms of Service (“Terms”) govern your use of the NSTINCT GG (legal entity name to be confirmed) website, rankings, scrims, tournaments, and memberships (the “Services”), operated by a Florida limited liability company. By using the Services, you agree to these Terms.
1. Eligibility
You must be at least 13 years old, consistent with Discord’s Terms of Service. Wager and certain competitive features may require you to meet additional age or jurisdictional requirements. You are responsible for ensuring your participation is lawful where you live.
2. Accounts and Verification
You must verify your Xbox gamertag through our verification flow. One Xbox gamertag may be linked to one Discord account. You are responsible for activity under your account and for keeping your credentials secure.
3. Acceptable Use
You agree not to cheat, smurf, use alternate or shared accounts to manipulate rankings, exploit bugs, harass other players, or otherwise undermine the integrity of competitive play. We may adjust ratings, remove results, and suspend or terminate accounts for violations.
4. Memberships and Billing
Paid memberships are billed through Stripe on a recurring basis at the price shown at checkout. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. [verify]
5. Wagers and Prizes
Where wagers or prizes are offered, escrow is handled by Matcherino. NSTINCT GG does not take custody of user funds and is not a party to the escrow arrangement beyond facilitating eligible, verified competition.
6. Disclaimer of Warranties
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
7. Limitation of Liability
To the fullest extent permitted by law, NSTINCT GG will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services.
8. Indemnification
You agree to indemnify and hold harmless NSTINCT GG and its members from claims arising out of your use of the Services or your violation of these Terms.
9. Termination
We may suspend or terminate your access at any time for violation of these Terms or to protect the Services. You may stop using the Services at any time.
10. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. The parties consent to venue in the state and federal courts located in Florida. [verify]
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
